Drone footage is cheap to produce and easy to sell. A lot of the aerial photography and mapping offered around commercial real estate comes from operators flying without the legal authorization to do it — which is a risk the property owner is taking on, usually without knowing it.
What Part 107 actually certifies
FAA Part 107 is the federal certification required to operate a drone commercially in U.S. airspace. It’s not a formality — the test covers airspace classification, weather minimums, airport proximity rules, and the operating regulations that govern where and how a drone can legally fly. A certified pilot knows, for example, whether the airspace over your site requires FAA authorization before a flight can happen at all, and how to get it.
Flying without that certification isn’t a gray area. It’s a violation of federal aviation regulation, and the property owner who hired the uncertified pilot is the one standing next to the drone when questions get asked.
Why this matters more near commercial and institutional sites
Aerial mapping for construction monitoring, pre-development site surveys, and marketing imagery often happens near exactly the kind of locations where airspace rules are strictest — dense urban cores, near airports, over occupied buildings with people below the flight path. That’s not the place to find out mid-project that the operator doesn’t have proper authorization for the site.
A Part 107 pilot flies the job with the legal authorization already sorted, files for airspace clearance when the site requires it, and operates inside the weather and visibility minimums that keep the flight — and everyone under it — safe.
What to ask before you book a drone shoot
If you’re bringing in aerial capture for a site survey, progress monitoring, or marketing imagery, it’s a fair question to ask directly: is the pilot Part 107 certified, and is the flight insured? A legitimate operator will answer both without hesitation. If the answer is vague, that’s the flight you don’t want happening over your property.
